September 10, 2003 Rumor or Lawsuit?
The other night as I surfed the net, I came upon a "story" I'm relating here. I honestly do not know if this is the truth, a joke, a made-up scenario or ..... Regardless there is a message here for educators and parents to heed. A parent felt his child (who was on an IEP) was not making adequate progress. He dug out the document he'd signed at the last IEP meeting and reviewed the goals, accommodations and modifications. He thought back to the meeting, remembering the inattentive stares of the general education teacher and the unenthusiastic statements about his son by the special education teacher. In rereading the accommodations and modifications, he decided to ask his 6th grade son how these strategies were coming along. The boy had no idea what his dad was talking about ... extra time, reduced work load, peer assistance, copies of notes .... none of the accommodations appeared familiar to his son. Knowing his son was frequently forgetful, untruthful, manipulative and controlling, the dad gave the special education teacher a call. The special teacher assured the father that accommodations were being used and the boy was making "adequate progress." Dad knew better! Upon speaking with the general education teacher, Dad was told there were no accommodations being made for his son and the child was not doing well due to his attitude, not lack of ability. NOT GOOD! This situation supposedly has lead to pending litigation by the parents against the school district. The general education teacher claims she was not informed about any accommodations. The special education teacher declares the accommodations were given to the classroom teacher. The parents are furious. The young man has not been afforded the education assured by law.
